Last Minute Buyer Shenannigans....

Our realtor called us this afternoon, day 14 of the 15 day escrow "perform or die" time limitation.

The buyers wanted a $5,000 price reduction due to asbestos in the 1942-era "popcorn" ceiling, and the "possibility of lead-based paint, both requiring remediation".

These items were fully covered in the home inspection report, and the disclosure, which they've had for quite some time now.

We damn near told them to take a hike, as we have no problem sitting here until spring. And if we do stay until spring, we'll probably get the ceilings scraped and refinished, and the house will go back on the market and sell for $550k, as long as the market doesn't tank.

Our realtor agreed it was definitely a cheap stunt to pull, especially considering they KNOW we aren't in any pressing need to move.

After he and my wife calmed me down a bit, we all agreed the best thing was to "Just Say NO!" to them, and if they pull out, no skin off our nose.

He called back a few minutes ago saying they accepted the "NO!", and things are still on.

Geez......some people's kids!

    I sure hope that I don't run up against any of that stuff. My plus is that I have a very sharp realtor, and know my buyer.

  2. Maybe they are trying to kill you off so they can get a better deal from the wife while she is still grieving.
    That kinda crap can cause people to stroke out ya know.
    I think I'd be letting them know in no uncertain terms that one there was the only stunt they get to pull or it's down the road they go.

    1. We already told them "NO!", and they accepted our decision.

      Escrow will close on September 20th, with funding a day or two earlier.

  4. I agree with WSF. They have someone more experienced calling their plays.

    At this point, tell 'em "Take it or Leave it".

    When I sell a property, I always have a clause wherein the buyers have to pay a $1k deposit that is NOT refundable after 5 days after inspections. Keeps the cheezball shit down. Too late for that now.

    1. Yep. They have $5k down with the same type of clause. If they wouldn't have acceoted our "NO!", we'd have $5k pocket money.

      BUT....that comes with caveats, too. Our realtor told us they could counter-sue, and keep they place tied up for months while it grinds through the court.

  5. I agree: it was a soft sortie, looking for weakness. If you'd given into that request, there'd have been others. Standing firm is the way to go. Glad they had the sense to back off.

    1. This was their last shot to get any concessions from us. After 15 days, it's all on the buyer to perform; i.e. get the loan and pay the seller.

      As far as we're concerned, the sale is accomplished, and all we're doing is waiting for the check to be deposited.

      Oh....and working on packing and moving!

      My first wife and I never tried a stunt like that when we bought our house, and my current wife didn't pull that, either.

      It's "swarmy" and petty to try to do something like like that at the last minute.

      I wanted to tell them to take a hike, but cooler heads prevailed.

<i>The Fisher Saga</i> Continues - Act III -

 Been working on this post since right after Thanksgiving. I'm making very good progress on the Fisher, and will most likely power it up...
