Wife In Another Accident

Just got back from the body shop where they took the car.

She was pulled over to the side of the road for a fire truck, and some young kid slammed into her.

He said he saw the fire truck, but not her.

TONS of witnesses, including the crew on the fire truck, the paramedic truck following them, and the ambulance following the paramedic truck.

And the owners of several stores at the intersection saw it, and came out and gave witness statements to the police.

The fire truck and paramedics said the car that hit her was traveling "well over the posted speed limit", and the two store owners said it looked like "he was going 70".

The driver that hit her admitted to the LBPD that he was going "over 45, maybe 50" and it's a 35MPH zone.

The ambulance crew wanted to take to the ER, and like a dummy, she refused. She had some weird kind of neck surgery some years ago before I met her, and that's why she can't shoot a rifle or ride a horse, because those motions could possibly injure her.

She was more concerned about saving the $$$$ for the collar, back board, and ambulance ride (they charge separately for all those things these days) than she was about getting checked out.

She's on the phone with the kid's insurance company right now (some place named "Alliance" who appears to have really crappy customer service), and I just heard her say she's calling her Doctor to get in today.........

    1. She's doing better than I thought, Rev.

      The neck brace/foam collar has helped keep the normal "loads" off her neck, so she's letting those muscles rest and heal.

  3. Get checked out, then go after kid's insurance for all it's worth. Also press to get him cited, because that automatically assigns guilt and makes collecting so much easier.

    1. She's at the Doctor's now. I told her that if she's in any pain at all after a day or two she should sue the snot out of the kid.

      He was clearly at fault, and he admitted he was doing well over the limit to the police and all the witnesses.

  4. Don't blame her for declining the ambulance ride. Sounds like a sensible, if not stubborn, woman.

  6. Pretty common, most people feel fine at first then it starts hurting. 3rd day usually the worst.

    1. Yeah, I've been through this before with her. She refuses immediate treatment/check up, and then two or three days later she's in pain, and even the Doctor tells her she should have come in immediately.

  7. Find an accident lawyer. We were rear ended, oddly, by a paramedic on the way to work one day. The fire department insurance dragged their feet on anything medical. Most will listen to the evidence and take the case for free, only getting paid if they win.

  8. Don't be in a hurry to sign anything relating to the insurance coverage. If she has a problem 3 months later, and you already signed a release/accepted a check, you are pretty much hosed. With her history, be real careful here.

  9. Sorry to hear about that! Hope she's doing better, but I imagine she'll be more sore today and tomorrow, as everyone else has said.

    I'm not clear on the accident. Did she get rammed from the side or the back? I guess that's not all that important, but it helps to envision the injury.

    1. It was a slightly off-center hit. The left rear quarter took most of the impact, but the trunk lid took a licking, too.

      Damage estimates are at around $9k, about what Blue Book is on it.

      She doesn't want to sue, but if this is going to cost us one red cent, I've told her we're going after the guy. She shouldn't have to take out another car loan for a new car, along with paying off the balance of this loan, because of some idiot's fault.

      As much as I dislike tort law, this is what it's for......

      She's feeling better than I thought she would considering the impact the car took, but then the car is designed to absorb the force, and people aren't so much!

      The foam collar I got for her really helps. They last two times she had an accident she didn't wear one, and really paid the price.

      She drove for 40 years with NO accidents, and now she's had three big ones in four years. We were joking that maybe marrying me was "bad luck" for her!

  11. Oh jeeze, kids and cars! Glad she seems OK but wait for the real MD diagnosis and maybe you better lawyer-up. The symptomatic injuries and medical issues over time can be real problematic and expensive. My wife still can only sleep on one side after our spin-and-roll thirty years ago, and we wouldn't have gotten anything but we had to sue her insurance for non-payment of uninsured-motorist when the truck company owner ran off to hide in Texas and a private detective found him. That's a whole blog-post itself...

  14. I'm really sorry to hear that happened. My wife has wrecked four cars in the last ten years, twice really bad accidents with massive hospital bills. I know how it feels.
