Lawyers, Guns, and Money

Couldn't think of anything else to call this.

I'm going to see a lawyer tomorrow concerning the settlement I've been offered over the injury I had last August.

No guns, but the will be a lawyer involved, and hopefully some money.

In the meantime, enjoy Warren. He left us far too soon.

    I learned a lot about Kalifornia law regarding Worker's Compensation claims. Turns out since this was an on-the-job injury, I *can't* sue my employer for negligence, even though the lawyer agreed that it was most probably their fault that the ONLY stairs on the ship that weren't painted with the high-traction, shoe-grabbing paint were the ones I slipped on, and fell down.

    Oh, well......at this point I'm forced to "play the game", and have a different Doctor examine me. There's no question that I have sustained "Permanent and Stationary" injuries, the question now becomes how much more severe are they than what the first Doctor decided on. So, I have to wait until the paperwork grinds through the system, get some more examinations, probably an MRI or two, and then see what the new Doctor states the "Percentage Disability" they are. At that point, there are certain rules about how the final settlement will be determined.

    The "good" thing about this is that the attorneys are limited to a 15% share of the settlement for all their fees and costs.

    The lawyer I went to was recommended by two different people I used to work with, and has quite a reputation for getting the best settlement possible for his clients. He indicated the percentage assigned to my injury was laughably low for this type of injury, and was typical of what the State Compensation Insurance Fund does.

    Should be an interesting "learning experience" for me.
